Ok. So this is getting out of hand with interpreting patent and copyright laws. Here's my two cents:  
 
Almost all guitar pickup ideas are based on existing designs created many years ago. Crossing features found in pre-existing formats may not constitute a new (patentable) idea. Randall Smith and Mr. Dimarzio may not see it that way, and that's a damn shame, because in my book that is disrespectful to Seth Lover and Leo Fender and all the men who actually created something new and original. So debating over who first built a humbucker in a p90 shell or a p90 in a humbucker shell is really moot. Both of those designs originated in the 50's and the possibility of combining them could have been sought before some of us were even born.
