Couldn't you make something like this with a pot with an SPST switch on the back of it? Break the connection to the tone pot and connect the signal to one side of the switch and the other side on to the tone pot.  
 
When the pot is turned up, it behaves normally. When you turn it all the way down to the OFF position, it would disconnect the tone control from the signal path. The disadvantage is that the pot switches on at full-cut instead of full-on, but the advantage is that it is a stock item and you don't have to modify the pot track.
