I agree that under common law, a contract has to pass the test of reasonableness in order to be enforcable, and if it's totally one-sided, the court will usually throw it out. As I recall from reading Dumble's NDA, he requires that you not allow a tech to service the amp if there is a chance that the tech might RE it. He also requires that you not sell the amp to anyone who might RE it. However, I did not see anywhere where he required that the NDA be passed onto any future owners. Could be wrong on that. Regardless, guys, going to court is a major hassle and it's expensive. Bad feelings, bad PR for everyone concerned, etc. The lawyers are the only ones who make any money. Sometimes it's just better to keep your head down and your mouth shut. Thank God for overseas sites in 3rd world countries, where taking legal action would be very difficult!! |
