I'm not commenting on the validity of his 'secrecy' agreement, but what's to stop someone from opening the amp, (and reverse engineering it), if he never signed such a "contract"?  
(EG)If he bought it used, or it's in for service.  
The original buyer may be in violation of the agreement, but I can't see how a 2nd hand owner or tech could be bound by it.
